1. Agreement to Terms

These Terms of Service ("Terms") constitute a legally binding agreement between you and Elite Rentals Canada ("Company," "we," "our," or "us") regarding your use of our vehicle rental services and website located at myagkaya-rediska.com.

By accessing our website or using our services, you agree to be bound by these Terms. If you do not agree with any part of these Terms, you must not use our services.

2. Rental Requirements

Age Requirements

• Minimum age: 25 years for all luxury vehicles
• Maximum age: 75 years (additional requirements may apply)
• Valid government-issued photo identification required

Driver's License

• Valid Canadian driver's license for residents
• International Driving Permit plus home country license for visitors
• License must be held for minimum 2 years
• Clean driving record required (verification performed)

Credit Requirements

• Major credit card in renter's name required
• Sufficient credit limit for security deposit
• Debit cards not accepted for premium vehicles

3. Reservation and Payment

Booking Process

Reservations can be made through our website, phone, or in person. All reservations are subject to vehicle availability and our approval process.

Payment Terms

• Full payment due at time of vehicle pickup
• Security deposit required (varies by vehicle type)
• Additional charges may apply for extras and services
• All prices subject to applicable taxes

Cancellation Policy

• Free cancellation up to 48 hours before rental start
• 24-48 hours: 50% cancellation fee
• Less than 24 hours: 100% cancellation fee
• No-show: Full rental amount charged

4. Vehicle Use and Restrictions

Permitted Use

• Personal and business use within Canada
• Must comply with all traffic laws and regulations
• Vehicle must be operated by authorized drivers only
• No commercial use without prior written consent

Prohibited Activities

• Racing, rallying, or competitive driving
• Off-road driving or driving on unsuitable surfaces
• Transporting illegal substances or contraband
• Smoking or vaping in vehicles
• Transportation of pets without prior approval
• Towing or pushing other vehicles
• Overloading beyond manufacturer specifications

5. Insurance and Liability

Insurance Coverage

All vehicles are covered by comprehensive commercial insurance. However, renters remain liable for:

• Insurance deductible amounts
• Damage below deductible threshold
• Loss of use during repairs
• Administrative fees

Additional Protection

Optional additional protection packages are available to reduce your liability. These must be purchased at the time of rental.

Renter Liability

Renters are fully responsible for:

• All traffic violations and fines
• Toll charges and parking tickets
• Damage caused by negligence or misuse
• Theft due to unlocked vehicle or visible valuables

6. Damage and Incident Reporting

Immediate Reporting Required

You must immediately report any:

• Accidents or collisions
• Theft or vandalism
• Mechanical problems
• Traffic violations while using our vehicle

Documentation Requirements

• Police report for accidents and theft
• Photos of any damage
• Contact information for involved parties
• Insurance claim documentation

7. Vehicle Return

Return Conditions

• Vehicle must be returned clean and in same condition
• Fuel level must match pickup level (or cleaning fee applies)
• All personal items must be removed
• Return must be at agreed location and time

Late Return Fees

• Grace period: 30 minutes
• 1-4 hours late: 25% of daily rate
• 4+ hours late: 100% of daily rate
• Unauthorized extension: theft charges may apply

8. Additional Fees and Charges

Additional charges may apply for:

• Cleaning fees: $150-$500 depending on condition
• Smoking fee: $500 plus professional cleaning
• Refueling service: Market rate plus $25 service fee
• Key replacement: $200-$1,000 depending on vehicle
• Traffic violation processing: $75 per incident
• Administrative fees for damage claims

9. Privacy and Data Protection

Your privacy is important to us. Please review our Privacy Policy to understand how we collect, use, and protect your personal information.

10. Limitation of Liability

To the maximum extent permitted by law:

• Our liability is limited to the rental fee paid
• We are not liable for indirect or consequential damages
• We are not responsible for personal property left in vehicles
• Force majeure events release us from obligations

11. Dispute Resolution

Governing Law

These Terms are governed by the laws of Ontario, Canada, without regard to conflict of law principles.

Dispute Process

1. Good faith negotiation (30 days)
2. Mediation through agreed mediator
3. Binding arbitration in Toronto, Ontario
4. Court proceedings (as last resort)

12. Modifications to Terms

We reserve the right to modify these Terms at any time. Changes will be effective immediately upon posting on our website. Your continued use of our services constitutes acceptance of any modifications.

13. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.

14. Entire Agreement

These Terms, together with our Privacy Policy and any rental agreement, constitute the entire agreement between you and Elite Rentals Canada.
